These Terms and Conditions govern paid clinic listings on Thai Clinics (thaiclinics.com), a directory operated by IT Ready Co., Ltd. ("we", "us", "the Company"). By submitting an upgrade request you confirm that you are authorised to act on behalf of the clinic and that you accept these Terms.
1. The Listing Service
What you receive: An upgraded listing (Premium or Featured) gives your clinic additional profile features and increased visibility within the directory, as described on the upgrade page at the time of purchase.
What we do not provide: We are a directory, not a medical referral service or a booking agent. We do not guarantee any number of enquiries, bookings, patients, or any particular search ranking on this site or on external search engines.
Featured placement: Featured slots are limited per city. Where slots are full, the tier will be shown as unavailable until a slot is released.
2. Fees, Payment and Renewal
Billing: Listing fees are quoted in Thai Baht unless stated otherwise and are billed annually in advance. Prices shown on the upgrade page are exclusive of VAT unless stated otherwise. Applicable Thai VAT and withholding tax will be handled in accordance with Thai law.
Invoicing: Invoices are issued by IT Ready Co., Ltd. to the billing details you provide. You are responsible for keeping those details accurate and up to date.
All payments are final: Fees paid for listings, upgrades, advertisements, or premium placement are non-refundable, including where you close your clinic, cancel mid-term, or stop using the service.
Late or failed payment: If payment is not received by the due date, we may downgrade, demote, suspend, or remove your listing without further notice, and may withdraw any promotional pricing previously applied.
Price changes: Fees may change at renewal. We will give you reasonable notice of any change to your renewal price.
3. Your Content and Responsibilities
Ownership and licence: You retain ownership of the text, images, logos, and other material you upload ("Your Content"). You grant us a non-exclusive, royalty-free licence to host, display, reproduce, resize, and distribute Your Content for the purpose of operating and promoting the directory, including in search results, category pages, and marketing of the site.
Accuracy: You are solely responsible for ensuring that Your Content — including services, prices, opening hours, doctors, qualifications, and certifications — is accurate, current, and not misleading. You must correct inaccurate information promptly.
Rights and permissions: You warrant that you own or have written permission to use all material you upload, including before-and-after images and photographs of premises, staff, and equipment.
Patient consent and privacy: Before uploading any before-and-after image, testimonial, or other patient-identifiable material, you must obtain the patient's documented consent to its publication, and you must comply with the Personal Data Protection Act B.E. 2562 (2019) and all other applicable privacy laws. You must not upload patient records or personal data beyond what the patient has consented to publish.
Medical advertising compliance: You are responsible for ensuring that your listing, promotions, and any medical claims comply with Thai law and regulations, including the Medical Facility Act, the rules of the Medical Council of Thailand, and the advertising requirements of the Ministry of Public Health and the Food and Drug Administration. You are responsible for holding all licences required to operate your clinic and provide the services you advertise.
Prohibited content: You must not upload content that is unlawful, false, defamatory, obscene, discriminatory, infringing, or that guarantees medical outcomes, or that misrepresents qualifications, accreditation, or affiliation.
4. Moderation and Editorial Control
Review of submissions: Changes to a claimed listing, before-and-after images, promotions, and posts are submitted for review and are published only once approved. We aim to review submissions promptly but do not commit to a fixed turnaround.
Our discretion: We may edit, reject, suspend, or remove any listing or content that we reasonably consider inaccurate, unlawful, non-compliant, misleading, or contrary to our standards, at any time and without refund where the cause is your breach of these Terms.
No verification: Except where a listing is expressly marked as verified, we do not independently verify the information clinics provide. Listing on the directory is not an endorsement, recommendation, accreditation, or certification of any clinic, doctor, or treatment.
5. Account Access
Authorised users: You are responsible for all activity carried out under the email addresses authorised to manage your listing, and for promptly removing access for people who leave your organisation.
Verification codes: Access is granted by one-time codes sent to authorised email addresses. You must keep those codes and the associated mailboxes secure.
6. Indemnity
You agree to indemnify and hold harmless IT Ready Co., Ltd., its directors, employees, and agents against all claims, demands, proceedings, losses, damages, fines, and reasonable legal costs arising out of or in connection with Your Content, your use of the directory, your breach of these Terms, or your breach of any applicable law — including any claim brought by a patient, a regulator, or a third-party rights holder.
7. Limitation of Liability
Service provided "as is": The directory is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free of security vulnerabilities, and we may suspend access for maintenance.
Exclusions: To the maximum extent permitted by Thai law, we are not liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or any indirect or consequential loss arising from your use of, or inability to use, the directory.
Cap: Our total aggregate liability to you in connection with the service is limited to the fees you paid to us for the listing in the twelve months preceding the event giving rise to the claim.
Nothing excluded unlawfully: Nothing in these Terms limits liability for fraud, or for any liability that cannot lawfully be excluded.
8. Relationship Between Clinic and Patient
Any consultation, treatment, appointment, payment, or dispute between a clinic and a patient is solely between those parties. We are not a party to it and accept no responsibility for the standard of care, the outcome of any treatment, or any refund owed by a clinic to a patient.
9. Suspension and Termination
By you: You may choose not to renew at the end of your term. Fees already paid are not refunded.
By us: We may suspend or terminate your listing immediately if you breach these Terms, if we are required to do so by law or a regulator, or if your continued listing would in our reasonable view expose patients or the Company to harm or legal risk.
Effect: On termination, your paid features cease. We may retain a free basic listing for the clinic as part of the public directory, and may retain records as required by law.
10. Changes to These Terms
We may amend these Terms from time to time. Each set of Terms is issued with a version code, and the version you accepted is recorded against your account at the time of your upgrade request. Material changes will apply from your next renewal or from the date you next accept them, whichever is earlier. Your continued use of the paid listing after a change takes effect constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the Kingdom of Thailand, and the courts of Thailand have exclusive jurisdiction over any dispute arising from them.
